In connection w ith the sale of Real Estate , Ve ndor has fu rnished P urchaser w ith a comm itment fo r an own er’s policy

Vendor has not e xecut ed, or pe rmitt ed an yone i n Ven dor’s behal f t o exe cute, any co nveyance, mortgage, lien, l ease,

security agreement, financing statement, or encumbranc e of or upon the Real Estate of any fixtures attached thereto, except a s

stated above, which is now outstanding or enforceable against the Real Estate. Ven dor has made n o contr act to sel l all or a part

of the Real Est ate to any per son other than the Purchaser, and Vendor has not gi ven to any pers on an option to purchase all o r

any part of the Real Estate, which is enforceable or exercisable now or at any time in the future. There are no unpaid claims for

labor done upon or m aterials furn ished for the Real Esta te in respect o f which lien s have be en or may be filed. Th e

improvem ents upo n the Real E state are all lo cated entirely within the bounds o f the Real E state, and the re are no

encroachments thereon. There are no existing vi olations of zoning ordinances or ot her restrictions appli cable to the Real Estate.

There is no jud gement of any cour t of t he Stat e of I ndiana or of any court of the United State that i s or may become a

lien on the R eal Estate. N o petition f or bankrup tcy has be en filed by o r against V endor with in the last six m onths, no r is an y

petition now pendi ng with respect to Vendor for bankr uptcy, insolvency or incompentency. Vendor is neither principal nor

suret y on any bond payable to the Stat e of Indiana.
