The Act gives Alberta a direct and distinct cause of action against manufacturers and wholesalers of opioid products to recover the cost of health care benefits caused or contributed to by an opioid-related wrong. The Act allows for the Crown to recover the cost of health care benefits incurred with respect to particular individual insured persons or on an aggregate basis, with respect to a population of insured persons. The Act governs other matters related to such an action, including: the type of evidence that is admissible to establish causation and quantify damages or the cost of health care benefits; joint and several liability of manufacturers and wholesalers and their respective directors and officers; limitation periods; and the retroactive effect of the Act.
